Terms of Service

1. Agreement to these terms

These Terms of Service form an agreement between you and DataDriven Trading (“DataDriven,” “DDT,” “we,” “us,” or “our”). By creating an account, purchasing or starting a subscription, submitting an application, or using our website, content, TradingView indicators, Discord community, or related services (collectively, the “Services”), you agree to these terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility and accounts

You must be at least 18 years old and legally able to enter into a contract. You must provide accurate information, keep your login credentials secure, and promptly notify us of unauthorized account activity. One membership is for one person and may not be shared, transferred, resold, or used to provide access to another person.

4. Trading risk

Trading securities, options, and other financial products involves substantial risk and may result in the loss of some or all invested capital. Options can expire worthless. Leverage can increase losses. Examples, alerts, charts, testimonials, hypothetical results, and past performance do not guarantee future results. Do not trade money you cannot afford to lose, and consider consulting qualified independent professionals before making financial decisions.

5. Memberships, trials, and recurring billing

Available plans and promotional offers are displayed before checkout. Offers may include a $1 introductory period for the Algo, a first-month Chatroom coupon, Swing access, or discounted Premarket Plus upgrades. Unless the checkout page expressly states otherwise, subscriptions automatically renew at the price and frequency shown at checkout until canceled. Taxes may be added where required.

By completing checkout, you authorize Stripe and DataDriven Trading to charge your selected payment method for the introductory amount and each recurring renewal. The checkout page controls if its pricing or timing differs from a general description on this site.

6. Cancellation, failed payments, disputes, and refunds

You can manage or cancel an eligible subscription through the Stripe billing portal linked from your member account. The effective date of cancellation is shown in the portal. Access may end immediately for a canceled introductory period or when a payment fails, remains unpaid, is refunded, reversed, or disputed. Otherwise, access may continue until the end of the paid billing period.

Except where required by law or expressly stated at checkout, charges are non-refundable after access has been provided. Contact us promptly if you believe a charge is incorrect so we can review it.

7. TradingView and Discord access

Certain memberships include access to an invite-only TradingView indicator, Discord roles, or both. You must provide the correct public username or connect the correct Discord account. Access is tied to an eligible membership and may be added or removed automatically. You are also subject to TradingView’s and Discord’s own terms and policies. DataDriven Trading does not control those services and cannot guarantee their continuous availability, interfaces, or account decisions.

8. License and intellectual property

We grant you a limited, personal, revocable, non-exclusive, non-transferable license to access purchased Services during an active entitlement. DataDriven Trading and its licensors retain all rights in the website, indicators, code, videos, lessons, graphics, branding, commentary, and community materials. You may not copy, record, download where no download is offered, redistribute, publish, sell, reverse engineer, scrape, or create derivative products from the Services without written permission.

9. Community conduct

You may not harass others, impersonate another person, publish unlawful or misleading content, distribute malware, solicit credentials, manipulate access controls, share paid content, or use the Services in a way that harms DataDriven Trading, its members, or third parties. We may moderate content or suspend access when reasonably necessary to protect the Services or enforce these terms.

10. Availability and changes

We may update, replace, pause, or discontinue features, lessons, indicators, channels, or integrations. Browser automation, third-party APIs, and connected platforms may experience delays or outages. We do not promise uninterrupted or error-free access, but we will make commercially reasonable efforts to operate the Services.

11. Disclaimers and limitation of liability

To the maximum extent permitted by law, the Services are provided “as is” and “as available,” without warranties of profitability, accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement. DataDriven Trading is not responsible for trading losses, missed opportunities, market data, third-party platforms, or decisions made using the Services.

To the maximum extent permitted by law, DataDriven Trading and its owners, team members, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or lost- profit damages. Our total liability for a claim relating to the Services will not exceed the amount you paid us for the affected Service during the three months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so those limitations apply only to the extent permitted.

12. Termination

You may stop using the Services at any time. We may suspend or terminate access for nonpayment, chargebacks, abuse, unlawful activity, material violations of these terms, or risks to the Services or other users. Provisions that by their nature should survive termination, including payment obligations, intellectual property, disclaimers, and liability limits, will survive.

13. Changes and applicable law

We may update these terms by posting a revised version with a new effective date. Material changes will apply prospectively as required by law. These terms are governed by the laws that apply to DataDriven Trading and your transaction, without limiting consumer rights that cannot legally be waived.
